MSME Reforms 2026: Why Faster Payments Matter

You can have strong orders and healthy margins, but if customers don’t pay on time, growth can quickly become a working capital crisis.

That is why the MSMED (Amendment) Bill, 2026, recently passed by Parliament, is significant.

The reforms focus strongly on one of the biggest challenges faced by MSMEs: delayed payments.

What changes?

  1. 50% interim payment: If a buyer challenges an award in court and the matter remains pending for more than six months, the court will be required to direct payment of at least 50% of the awarded amount, subject to the amended law.
  2. Time-bound dispute resolution: Mediation is proposed to be completed within 90 days, followed by defined timelines for arbitration.
  3. Stronger recovery: Mediated settlements and arbitration awards can be recovered as arrears of land revenue.
  4. Greater use of TReDS: Central Public Sector Enterprises will be required to use TReDS for settlement of MSME invoices, helping businesses access working capital against receivables.
  5. More Facilitation Councils: States will have greater flexibility to establish MSEFCs, potentially helping reduce the backlog of delayed payment disputes.
  6. Decriminalisation: Certain offences will move towards warnings and graded civil penalties rather than criminal consequences.

Why does this matter?

For a small business, an unpaid ₹20 lakh or ₹50 lakh invoice isn’t just an accounting entry.

It can mean delayed salaries, supplier payments, tax payments, inventory purchases and expansion plans.

The real objective of these reforms is therefore bigger than simply recovering outstanding invoices.

It is about giving MSMEs greater certainty over their cash flows.

Of course, legislation is only the beginning. The real test will be implementation, faster dispute resolution, effective enforcement, wider TReDS adoption and greater awareness among MSMEs.

If implemented well, these reforms could make a meaningful difference to India’s small businesses.
